Self Employed - Sole Trader
Most agencies will no longer engage sole traders to work for their clients. It is necessary to have a proper legal structure in place such as an umbrella company.
Being self employed or a sole trader remains a legitimate way to operate, particularly where you might have a number of concurrent clients. However, it is important to recognise that clients are now increasingly asking for liability and professional indemnity insurance to be in place, and in many cases have taken decisions that they can no longer engage sole traders because there is no legal entity in place.
If you continue to operate in this way, you are still at potential risk from being deemed a disguised employee of any client that you work for, which could subject you and your client to retrospective tax bills, fines and interest.
